It’s Illegal to Take Photos at These Places in Maine

We understand that it’s easier now than ever to capture perfect moments. With seemingly professional-grade photography equipment in our pockets, we can take pictures and share them with anyone in the world instantly. It’s so easy, and we love it.
However, there is a time and a place for everything, and sometimes that instant gratification just isn’t worth the legal and physical risks.
If you're looking for the perfect scenery for your next family photoshoot, Instagram story, or a cool picture to send to grandma and grandpa, make sure you're not breaking any laws. Trespassing is illegal, and you wouldn't break into someone's house or a store after closing time—that's common sense.
But not every law in Maine is as obvious as that.
Under Maine law, specifically Title 23, Part 7, Chapter 611 on railroad safety, it is illegal to stand or walk on railroad tracks or bridges without permission. This includes stopping to snap a picture on them.
The penalties for these violations are as follows:
- For a first-time offense of standing or walking on tracks or bridges, the fine ranges from $50 to $100.
- A second offense increases the fine to between $250 and $500.
- A third offense results in a fine of $750 to $1,000.
- A fourth or subsequent offense is considered a Class E crime.
- Entering a railroad track with a vehicle is also a Class E crime and is treated as a strict liability offense, meaning intent does not need to be proven.
This law aims to enhance safety by keeping unauthorized individuals and vehicles off railroad tracks and bridges.
Additionally, taking photos on train tracks is not just illegal; it’s also incredibly dangerous.
Trespassing on train tracks can lead to legal trouble, with fines and even arrest. More importantly, however, trains are often much quieter and faster than expected, making it easy to misjudge their arrival.
Above all, the risks involved can be deadly, as there's little time to react if a train suddenly appears.
